A Significant Judgment in a Personal Injury Case involving a Falling Tree

The case of Cavanagh v Whitley Parish Council & Kevin Shepherd found in favour of the claimant.  HHJ Sir Alistair MacDuff found that despite Whitley Parish Council having a three year cycle of tree inspection in place, it was negligent in not having assessed the subject lime tree on a more frequent basis because it was in a ‘high risk’ area.  The tree was located behind two benches beside a bus stop and failed in January 2012 striking a single deck bus and causing serious personal injury to the driver, Mr Andrew Cavanagh.  Dr O’Callaghan was instructed on behalf of the claimant.

Another Significant Case in Tree Related Subsidence

The case of Pattichis v LB Enfield (London County Court TCC List) went to the issue of whether the implicated tree had at all time prior to the subsidence damage posed a ‘real risk’ or simply just ‘a risk’, i.e. was it reasonably foreseeable that the tree would, at some time cause subsidence damage.  Dr O’Callaghan was instructed on behalf of the defendant Borough Council.

Dealga O’Callaghan is Tree Risk Assessment Qualified

Dealga successfully completed the International Society of Arboriculture (ISA) Tree Risk Assessment Qualification (TRAQ). He attended the course run by the Consulting Arborist Society (CAS) on behalf of the ISA at the National Centre for Arboriculture at Myerscough College near Preston Lancs on 30th March to 1st April 2016 and passed both the field assessment and written examination with very high scores.
